Judicial vs. Non-Judicial Foreclosure

Most eastern states require court intervention in a foreclosure proceeding, therefore, they are judicial foreclosure states. Predominantly, loans in Montana are created by a Deed of Trust and the procedure is dictated by state statute, making most  foreclosures in Montana non-judicial.  However, if the deed of trust does not contain power of sale language, the lender may seek judicial foreclosure.
